Dino maintains suspension of secret budget amendments

Dino says that Congress did not send all documents on the amendment to the STF

The Minister of the Federal Supreme Court (STF) Flávio Dino decided this Thursday (10) to maintain the suspension of payment of parliamentary amendments RP8 and RP9 (commission and rapporteur amendments to the budget), called the “secret budget”.Dino maintains suspension of secret budget amendments

The decision was signed by the minister after a conciliation hearing held this morning between representatives of Congress and the Executive.

Dino understood that the Congress representatives did not present “specific, complete and precise information” to prove compliance with the Court’s decision that determined the end of the secret budget amendments.

For the minister, the release of the amendments will not occur until transparency and resource traceability measures are fully adopted by the Chamber and the Senate.

“In view of the above, in view of the shortcomings in compliance with judicial determinations, it remains unfeasible to reestablish the full execution of parliamentary amendments in the current fiscal year of 2024, until the Legislative and Executive Powers are able to fully comply with the constitutional order and the decisions of the plenary of the STF”, he decided.

In December 2022, the STF understood that the amendments called RP 8 and RP 9 are unconstitutional. After the decision, the National Congress approved a resolution that changed the rules for distributing resources through rapporteur amendments to comply with the Court’s determination.

However, Psol, the party that filed the lawsuit against the amendments, pointed out that the decision continues to be in non-compliance.

After the retirement of Minister Rosa Weber, the original rapporteur of the case, Flávio Dino took over the management of the case.

In August of this year, Dino ordered the suspension of the amendments and decided that the transfers must follow traceability criteria. The minister also ordered the Comptroller General of the Union (CGU) to audit the transfers made by parliamentarians through amendments to the secret budget.
