Gilmar Mendes votes to keep CBF president in office

Minister Gilmar Mendes, of the Federal Supreme Court (STF), voted this Wednesday (9) to maintain his own decision that determined the return of the president of the Brazilian Football Confederation (CBF), Ednaldo Rodrigues, to office. Gilmar Mendes votes to keep CBF president in office

The previous decision was handed down on January 4th of this year and overturned an injunction from the Rio de Janeiro Court that removed Ednaldo from office.

In this Wednesday’s session, the plenary began to decide whether to endorse Gilmar Mendes’ decision. However, a request for review made by Minister Flávio Dino suspended the trial.

There is no date for the resumption of the analysis of the case, and, with the suspension, the January decision that determined the president’s return to office continues to be valid.

In December last year, the Rio de Janeiro Court of Justice (TJ-RJ) decided to remove Ednaldo Rodrigues from office. On that occasion, the 21st Chamber of Private Law extinguished the Public Civil Action filed by the Public Ministry (MP) against elections that had been held irregularly by the CBF in 2017.

In view of the process, the highest entity of Brazilian football agreed to sign, in 2022, a Conduct Adjustment Term (TAC), which, among other things, established the holding of a new election, in which Ednaldo Rodrigues emerged victorious.

The decision to remove Ednaldo Rodrigues from the CBF was taken in response to a request from former vice-presidents of the entity, who lost their positions under the 2022 TAC. For TJ-RJ, the TAC signed between the MP and the CBF was illegal.

After this court decision, minister Gilmar Mendes granted the injunction to keep Ednaldo Rodrigues in office.

For the STF minister, FIFA, the highest entity that regulates football in the world, sent successive letters to Brazil stating that it did not recognize as legitimate the intervenor appointed by the TJRJ for the CBF, José Perdiz, president of the Superior Court of Sports Justice (STJD) . The minister also reiterated the risk of the men’s Olympic team losing the pre-Olympics because it does not have an internationally recognized leader.
