President of Osiptel on his suspension: Premier Adrianzén lacks impartiality

The executive president of Osiptel, Rafael Muentespoke about the decision of the Presidency of the Council of Ministers (PCM) to suspend it for one year of his duties in the telecommunications regulatory body for a period of one year. This is due, according to the ministerial resolution, for having incurred the offenses provided for in article 85 of the Civil Service Law.

The official asserted that the administrative procedure initiated by the PCM exceeded all the legal deadlines dictated by the regulation in this area and has broken all the rules of due process, in addition it has been resolved impartially by Prime Minister Gustavo Adrianzén, with whom he had a troubled professional relationship in the past.

“(The administrative procedure) has been resolved by Mr. Gustavo Adrianzén, president of the Council of Ministers, who is involved in the cause of abstention due to his lack of impartiality given the proven animosity towards me, which arises from an eventful professional relationship that dates back to 2005. This is the same authority that, months ago, sought to merge the regulatory bodies,” Muente said in a statement.

He defends himself

Muente explained that the contracting of training, which is the reason for the initiated process, complied with all legal procedures, having been ignored for the issuance of the aforementioned Ministerial Resolution, the report of the Institutional Control Body (OCI) of the Comptroller’s Office General of the Republic, which concluded that there are NO elements of judgment that denote the transgression of the provisions contained in the State Contracting Law.

He indicated that the opinion of the National Civil Service Authority (SERVIR) which specifies that officials are authorized to receive job training type training is also not taken into account; nor the report of the Technical Secretariat of the Investigative Bodies of the Disciplinary Administrative Procedure, which ordered the archiving of the disciplinary control action because there were no elements that would allow evidence of facts that constitute an administrative disciplinary offense.

“In my 40 years of professional life in the public and private sectors I have always acted with the highest standards and with absolute professional ethics, honesty and total rejection of any act of corruption,” he said.

Muente affirmed that he will resort to all legal authorities to safeguard his honor, dignity and right to work for the country, always prioritizing citizen well-being and not private interests.
