ADOBAD says decree facilitates marketing of electronic games of chance

The Dominican Association of Sports Banks (ADOBAD) said this Thursday that a presidential decree issued on December 23, 2019 is in favor of the National Equestrian Commission.

As explained in a statement, through said decree, which updated the National Equestrian Regulations, this commission was given the power to issue licenses so that establishments called “equestrian agencies” can market electronic games of chance.

They argue that this provision, contained in articles 2 and 5 of Decree No. 480-19, supposedly contradicts what is established by laws 494-06 and 253-12, which attribute to the Ministry of Finance the exclusive competence to regulate all types of games. random in the country.

“This is a flagrant violation of the Constitution by the Executive power, which ignores the authority of the National Congress, while failing in its constitutional duty to ensure the faithful execution of the laws,” they stated.

They explain that as a result of this situation, the National Equestrian Commission has allegedly issued licenses for the commercialization of electronic games of chance, which has led to the installation of “equestrian agencies” throughout the country, without them complying with the requirements demanded by the current regulations to offer these services.

“This curtails the rights acquired by investors who operate sports betting banks, casinos and game rooms,” they warned.

Likewise, they indicated that, with the purpose of correcting the situation, ADOBAD sent a letter to President Abinader to issue a decree that suppresses the previous one, but that so far they have not received any response.

“Such devastating apathy on the part of the Executive Branch has forced us to go to the Constitutional Court, before which we have filed a direct action on unconstitutionality to promote the annulment of the aforementioned provisions of the decree, which attack the principle of separation of public powers and the legislative powers of the National Congress”, they concluded.
