Benji Espinozaprosecutor’s lawyer Luz Elizabeth Peraltaannounced that he will request that the hearing be rescheduled where the request for preventive detention against his client will be reviewed. According to the lawyer, the Judiciary did not notify him in time about the request for the precautionary measure.

“Until this moment we have not received any formal notification of the request for imprisonment and a hearing summons. (…) I, as Dr. Peralta’s lawyer, have not received anything. I have only received it from the Prosecutor’s Office the formalization provision, but I don’t get anything from the Judiciary,” he said on Canal N.
Given this, Espinoza pointed out that the defense requires that he be guaranteed effective defense, reasonable time and equality of arms, which he considered to be violated in his case. In that sense, he indicated that he cannot adequately prepare his presentation in response to the request of the Prosecutor’s Office and pointed out that “the field is unbalanced.”
“An effective defense states that it is not symbolic or decorative, it must be a true defense. To be a true defense, a reasonable amount of time is needed to study the entire request, its annexes and defenses. With this comes the issue of equality of weapons because if you do not guarantee defense or reasonable time, then we have to say that the field is unbalanced,” he indicated.
This Thursday night, the Second Transitory Supreme Prosecutor’s Office Specialized in Crimes Committed by Public Officials requested 18 months of preventive detention for Andres Hurtadoalso known as ‘Chibolín’; the prosecutor Luz Elizabeth Peralta and Augusto Javier Miu Lei. All of them are being investigated for the alleged crime of influence peddling and others to the detriment of the State.
