Deputies discuss reform to transfer the National Guard to the Sedena

The Board of Directors of the Chamber of Deputies of the LXVI Legislature issued, this Tuesday, September 17, the declaration of publicity of the opinion that reforms various articles of the Political Constitution, where the assignment of the National Guard to the Secretariat of National Defense (Sedena) is proposed.

The reform initiative seeks to modify articles 13, 16, 21, 32, 55, 73, 76, 78, 82, 89, 123 and 129 of the Political Constitution, changes that seek to make the Sedena part of the permanent Armed Forces (Army, Air Force, Navy) and have the power to investigate crimes.

Last year, the Supreme Court of Justice of the Nation (SCJN) declared unconstitutional reforms to four laws regarding the National Guard in which, at the proposal of López Obrador, the majority of Morena and allies had authorized the administrative, budgetary, organic, functional and command transfer of the National Guard from the Secretariat of Security to the Sedena.

The Court’s decision was due to the fact that the Constitution expressly mandates that the GN must be civilian.

That is why the president has now directly proposed changing 12 articles of the Constitution to give that institution military command with all its administrative, budgetary and operational consequences.
