Minister Alexandre de Moraes, of the Federal Supreme Court (STF), granted a 24-hour deadline for the social network X to prove the legality of the new representation established in Brazil.
The minister’s decision was made after the network informed the Supreme Court that lawyers André Zonaro Giacchetta and Sérgio Rosenthal will legally represent the company in the country.
Moraes asked billionaire Elon Musk’s social network to prove that the professionals will be his new representatives.
The company must send the minister documents of registration with the Commercial Board and proof of the appointment of the lawyers mentioned to officially represent it.
“There is no proof of the return of X Brasil Internet LTDA’s activities, nor of the regularity of the appointment of its new legal representatives or even its new lawyers,” said the minister.
Failure to comply with decision
Earlier, Moraes fined the social network R$5 million. The measure was taken after the company circumvent the decision what suspended the network last month.
The suspension was determined after the end of the 24-hour deadline given by the minister to MusK to indicate a legal representative in Brazil. The decision was confirmed by the First Chamber of the Court.
On August 17th, Musk announced the closure of the headquarters of the company in Brazil after the social network was fined for refusing to comply with the order to remove profiles of those investigated by the Court for publishing messages considered antidemocratic.
