'Little tricks' in Congress could be slowing down the process of labor reform

The process of the labor reform in the House of Representatives is not progressing as the Government wants, since the stage of impediments has barely ended and when it was preparing to define the report that would review the articles, The process had to be postponed again due to lack of quorum.

With less than three months to go until the end of the first part of this legislative period and with three pending debates (one in the House and two in the Senate), the atmosphere in Congress does not seem to be the best and the possibility of this initiative being sunk is increasing, since more and more people are filing propositions and impediments and the lack of quorum strategy is applied more frequently.

For now, things are going in such a way that next Monday – September 23 – it will be decided whether to archive, sink or put to a vote the article promoted by the Ministry of Labor, which has not managed to convince, despite the strong lobbying that it has been carrying out in the plenary sessions and the invitations of the coordinators who report to have the debate.

María Fernanda Carrascal, representative who leads the labor process in Cámara, stated that the opponents of the project have been passing it on from “little trick to little trick” and that this has become a stumbling block, to such an extent that the session of last Wednesday, September 18 had to be postponed due to lack of quorum.

“After seeing the obstacles, we are now going to listen to the proposals. Next comes the archive proposal, the negative proposal, and then the majority proposal, which is the positive one. But we have not been able to move forward, because they have been passing from one ‘little move’ to another. We started the week with a proposal about Venezuela, any one, telling us that we were going to see who was in favor of rights and who was not. Who was in favor of democracy and who was not,” said Carrascal.

One of the striking data in the first assessment of what has been carried out so far in the labor reform, has to do with the 126 impediments that were filed and the 387 proposals that must be taken into account for what is to come and add pressure to the plenary debate, since they could translate into greater slowness for a process that is increasingly running out of time.

The Minister of Labor, Gloria Inés Ramírez, said that there were “four recusals that were already sent to the Ethics Commission, we have 387 proposals and we have made progress with the presentation of the filing report and the filing proposal. Next week they will be voted on and we will move on to the majority reform, which is the reform of debate of this labor reform that the country requires.”

Ramírez Ríos added that “this reform has protection for family work, This reform has the possibility that with the agricultural contract, field workers can access social security, this reform has clearly stipulated the processes of labor reconversion, it has special contracts, it is stabilized, that is, it is a reform that also formalizes.”

Both the Ministry of Labor and the labor representatives insist that this project is necessary to guarantee labor dignity to millions of Colombians, which is why it cannot be sunk again. However, for employers there are many elements to review, starting with the increases in labor costs, which could end up favoring informality, especially in these times of slowdown.
