Bill to modify the DNI arrives in the Senate

Santo Domingo.- The Executive Branch submitted this Thursday to the Senate of the Republic the bill that modifies Law No. 1-24, which creates the National Intelligence Directorate (DNI) of January 15, 2024.

The modifications established in said project, headed by the president Luis Abinader and with the mediation of the EP’s legal advisor, Antoliano Peraltawere previously agreed upon at a working group made up of representatives of the Government and sectors of organized civil society.

In a statement issued by the Presidency, it states that, “the purpose of the legislative initiative now proposed is to modify the provisions contained in articles 1, 2, 9, 10, 11, 26 and 32 of Law No. 1-24, with the purpose of achieving the greatest possible clarity and specificity regarding the constitutional subjection of each of these provisions of the aforementioned law.”

They also highlight that, among the most relevant aspects that this project seeks to modify, the proposal to merge articles 1 and 2 of Law No. 1-24 to define in the new article 2 key terms such as intelligence, strategic, military and criminal intelligence, open sources and closed sources, among others.

They also seek to modify numeral 16 of article 9 to ensure coordination between the National Intelligence Directorate (DNI) and the Dominican Institute of Telecommunications (INDOTEL) in the protection of user privacy.

He added that an adjustment is proposed to Article 11 of Law No. 1-24, in order to strengthen the guarantees relating to obtaining the content of information from closed sources.

In this sense, the legal amendment seeks to require the authorization of a judge for any procedure that limits constitutional rights.

Thus, this bill addresses the main concerns that existed regarding Law No. 1-24, with the aim of ensuring that the regulation of the national intelligence system is as closely aligned as possible with the constitutional provisions.
