Netflix VAT payment will be made starting in December

Payment of the VAT by digital platforms such as NetflixSpotify, Amazon, among others, will be carried out starting in December and no longer in October, according to legislative decree (DL) 1644 published today in the legal regulations.

This new date is part of the amendments to the General Sales Tax and Selective Consumption Tax Law that regulates the operation of remote games and remote sports betting.

“Considering the need to implement certain systems for the implementation of the provisions of the standard, it has been considered appropriate to grant an additional period for its effective application,” the standard reads.

GAMES AND BETTING

DL 1644 also establishes that remote gaming and remote sports betting are included within the scope of the 1% ISC.

The following are subject to this tax: “players, in the case of remote games and remote sports betting developed on technological platforms operated by legal entities established abroad, holders of an authorization granted by the competent authority,” it reads.

Recently, the Minister of Economy and Finance, José Arista, stated that the aim of the law is to increase tax collection. He indicated that the regulation was complicated and that is why they requested powers.
