Aberrant and arbitrary attempts by the Court against the reform process: AMLO

President Andrés Manuel López Obrador emphasized that there is no legal or constitutional basis for the Supreme Court of Justice of the Nation (SCJN) to stop the legislative process for the discussion and, if necessary, approval of the reform to the Judicial Branch.

In the morning press conference, in response to a question about the appeal that seeks to stop the process and which was welcomed by the president of the Court, Norma Piña, the president considered that it would be aberrant and arbitrary for the highest court to resort to that strategy, since according to the Constitution the procedure corresponds to the Executive and the Legislative.

“I feel that they have no legal basis. It would be an aberration and a flagrant violation of the Constitution to stop the process of analysis, discussion and, if appropriate, approval of the constitutional reform dedicated to the Judiciary.

There is no constitutional basis for this, it would be arbitrary and it would affect public life, it would affect what should be a genuine state of law; it would be like opting for the law of the jungle, making it clear that they do not care about democracy or justice, that they are only thinking about their interests, their privileges and that they are openly in favour of corruption.

He said he hoped that this request would not be successful in the Court.

“Because someone in the Judiciary, not just one, I hope several, especially in the Court, will react, as happened when, in fact, the president referred a resource that did not correspond to her to interfere in the autonomous decision of the Electoral Tribunal and a minister argued that it was not the Court’s function to intervene in what corresponds to the Electoral Tribunal.

But now it is worse, because it is the intervention of the Court or pretending that the Court or the Judiciary stop a process that according to the Constitution corresponds, in this case, to the Executive and the Legislative.

According to the Magna Carta, he reiterated, the Executive has the power to present initiatives to reform it, that’s what we did; and it is up to the Legislature to discuss and decide whether or not to approve them.

The judiciary cannot do this, that is not its function, it would be a crude interference, rather than an outburst. That is why I do not believe that this purpose will succeed.

He also called on opposition legislators not to let themselves be pressured. by the head of the power mafia and defender of the interests of the country’s corrupt minoritiesClaudio X. Gonzalez.

He stated that the businessman He is openly talking to senators to vote against the reform.

For this reason, he asked the members of the Senate – where the opinion approved a few days ago in the Chamber of Deputies is located – to act independently, freely and to put those of the people and the nation before their personal and party interests.

It is not in Mexico’s interest to maintain a judiciary that is subject to crime. The judiciary is rotten, invaded by corruption, justice is not dispensed for the benefit of the people of Mexico, it is a power that has been hijacked, taken over, at the service of organized crime and white-collar crime.

The President considered that when the reform in question is approved it will be a holidaysince the Constitution will be respected and the ministers will not be able to earn more than the President and the people will be able to elect the members of the Judicial Branch by direct vote.
