The Federal Supreme Court (STF) decided this Friday (6) to reject appeals from companies that operate social networks against decisions by Minister Alexandre de Moraes that determined the blocking of profiles that spread messages of misinformation and attacks on democracy.
The decision was unanimously taken by the Court’s First Chamber during a virtual trial, a modality in which ministers enter their votes into an electronic system and there is no in-person deliberation.
The panel followed the vote cast by Moraes. For the minister, the social networks X (formerly Twitter), Discord and Rumble cannot legally oppose decisions involving users of the platforms.
“It is not possible for the appellant to oppose the blocking of channels, profiles and accounts, in accordance with the decision handed down in these proceedings, since this is a right of third parties under investigation, and as it does not allow for appeal through the chosen means”, he stated.
The vote was supported by ministers Flávio Dino, Cristiano Zanin, Luiz Fux and Cármen Lúcia.
Last week, Alexandre de Moraes ordered the suspension of the X network. The measure was taken after billionaire Elon Musk, owner of the social network, failed to comply with the 24-hour deadline given by the minister to appoint a legal representative for X in the country.
Musk closed the office in Brazil and did not comply with the order to remove profiles of those investigated by the Court for publishing messages considered antidemocratic and with offensive content to members of the STF.
