Accident in Azua: Preventive detention will be requested today against truck driver

Accidente en Azua: Solicitarán hoy prisión preventiva contra conductor de camión

Azua.– The Public Prosecutor’s Office requested the imposition of Preventive detention for the truck driver who caused the death of six people last Sunday and injured more than 40 people who were sharing a business in the section Bastida, from the municipal district of Villarpando, from the Las Yayas municipality of Viajama.

The request for preventive detention was filed by the Office of the Prosecutor before the Ordinary Justice of the Peace Court of Las Yayas de Viajama against the accused Ángel Encarnación Bautista, who faces preliminary charges for reckless driving, speeding, involuntary blows and injuries causing permanent injuries and involuntary blows and injuries causing death.

The hearing for the coercive measure was set for this Wednesday, September 4, starting at 10:00 a.m., in the chambers of the Azua Justice of the Peace Court, where the Public Prosecutor’s Office will be represented by attorney Juan Diego Ramírez Galván.

In relation to the case, the Public Prosecutor’s Office stated that Encarnación Bautista, who is a merchant in the province of San Juan, was moving through the area at excessive speed and in a reckless, foolhardy and negligent manner, with disregard, inadvertently and clumsily, and without taking the necessary precautions, in a red, cargo-type motor vehicle, Daihatsu brand.

The incident occurred at around 1:50 a.m. on Sunday, September 1, when the accused was traveling along the San Juan-Azua highway, specifically, in front of a grocery store in said municipality, heading west-east, loaded with avocados.

The accused hit and ran over the crowd with the truck, resulting in the deaths of José René Guzmán Guzmán, Génesis Arias Alcántara, Elvin Guzmán Rodríguez, Deury Ferreras Matos, Yohennys Soriano Méndez and Jhon Deivy Geraldo Matos after presenting, most, severe cranial and facial contusions, while more than 40 were left with blows and wounds or physical damage with injuries.

In the instance, the Ministry Public emphasized that preventive detention should be imposed against Encarnación Bautista as it is the most suitable measuresince it does not offer guarantees to appear at the proceedings and submit to them, because it does not have sufficient roots to rule out the risk of flight.

In this regard, he reiterated that in his case there is a latent risk of flight, since he fled after the accident, and, upon learning of the persecution against him, he proceeded to turn himself in, in addition to the fact that the facts attributed to him carry the imposition of prison sentences.

He also justifies the imposition of the measure by stating that he has exhibited similar behavior in other cases that will be presented to the court.

The justice system body also maintains that the accused drives recklessly and violates all legal precepts, specific to the matter, disregarding all citizen safety and the observance that must be taken into consideration, after establishing that in the Criminal Investigation System (SIC) he appears with 28 infractions for violating Law 63-17 on Road Traffic.
