Judge halts discussion of judicial reform in Congress

For its part, the third district court of Amparo and Federal Trials in the state of Chiapas, based in Tuxtla Gutiérrez, granted a provisional suspension to four complainants against the discussion against the ruling that modifies articles 17, 20, 76, 89, 94, 95, 96, 97, 98, 99, 100, 101, 105, 107, 110, 111, 113, 116 and 122 of the constitution.

The federal judge considered that the Congress of the Union did not declare the expiration of the legislative process of judicial reform, at the end of the 65th legislature and therefore ordered that if it were to be discussed in either of the two Chambers Do not send to local congresses and to Mexico City for discussion until the final suspension is resolved.

These appeals are made one day before the new federal deputies and senators elected on June 2 begin their work.

Morena and allied parties have a majority in the Chamber of Deputies and are one or two legislators away from achieving a qualified majority in the Senate to easily approve any reform, including the Judicial Reform.

It also comes amid protests and a work stoppage by judiciary workers across the country. Protesters argue that the proposed reform minimizes careers in this institution and would determine ministers, judges and magistrates based on political sympathies.

What does judicial reform entail?

The Supreme Court of Justice of the Nation (SCJN) will be completely removed to make way for ministers elected at the polls in 2025, while judges and magistrates will be relieved in a staggered and gradual manner: half next year and a public raffle or selection will decide whether their position will be submitted to the polls or not.

According to the proposal, the election will be held on the first Sunday of June 2025, and all the ministers of the SCJN will be elected, as well as two vacant magistrates of the Superior Chamber of the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF), magistrates of the five regional chambers of that Tribunal, and the members of a new Judicial Disciplinary Tribunal -so far 35 positions- and half of the positions of the judicial circuit.
