Judge bans Brazil from sharing evidence of Jorge Barata with Peru

Judge José Dias Toffoli, of the Supreme Federal Court of Brazil, prohibited his country from sharing with Peru the evidence of the Lava Jato case related to the former directors of Odebrecht, Jorge Barata and Luiz Antonio Mameri.

In Dias Toffoli’s resolution, issued on August 20, it is noted that the decision was taken at the request of Barata and Mameri, two important informants for the Peruvian Prosecutor’s Office.

The request is based on the order issued by the same judge in 2023, in which he ruled that, in principle, the evidence obtained through the MyWebDay and Drousys computer systems could not be used for the trial of former President Ollanta Humala.

However, the former company executives asked for clarification on that ruling, arguing that the Peruvian authorities continue to summon them to testify in other cases, such as those of Keiko Fujimori and Alejandro Toledo.

As a result, the Brazilian judge ruled in his latest ruling that this ban extends to everything involving Jorge Barata and Luiz Mameri.

“I partially agree to the request made by these files and to extend the effects of the decisions issued to declare the uselessness, according to the Brazilian legal system, with respect to the complainants, of the evidence obtained through the Drousys and My Web Day B systems, used in the Odebrecht collaboration agreement,” reads the document accessed. He also ordered that all proceedings initiated via International Judicial Cooperation be annulled. In this way, the former Brazilian executives will no longer testify in the criminal proceedings that began in the Peruvian courts,

Barata, who was superintendent of Odebrecht in Peru, acknowledged paying bribes to public officials and illegally contributing to the political campaigns of Keiko Fujimori, Ollanta Humala, former mayor Susana Villarán, among other politicians.

Mameri, the former director of the construction company for Latin America, supported Barata’s revelations, since he was also part of the bribery system deployed by the company.
