He Executive power promulgated this Friday Legislative Decree No. 1636, which seeks to reactivate the public works paralyzed. The regulation modifies Law No. 31589, with the aim of streamlining and simplifying the reactivation of paralyzed projects.
The decree includes measures to optimize the reactivation of works that are part of the National System of Multiannual Programming and Investment Management. In this sense, it speeds up the preparation of reports on the status of paralyzed works.
The owners of the entities may request the Investment Executive Units (UEI), inspectors or supervisors to prepare these reports, as well as directly contract these services if it is considered urgent.
This measure seeks to reduce waiting times and speed up decision-making regarding the reactivation of works. In addition, it highlights the urgency in contracting to reactivate works under the State Procurement Law.
In this regard, direct contracting is permitted for the preparation of technical files and the execution of work balances and for supervision.
In addition, it allows for inviting previous bidders or contracting directly with suppliers. It also establishes specific measures for the reactivation of works carried out under the Direct Administration modality. This allows for the contracting of the preparation and supervision of technical files up to a certain amount through special procedures.
The decree also regulates a special selection procedure for contracts, with adapted rules to simplify and speed up the process. The aim is to make the awarding and execution of contracts more efficient and to improve transparency.
