The Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) ratified yesterday the allocation of seats in the Senate as resolved by the National Electoral Institute (INE) for the legislature that begins this Thursday.
The court rejected the challenges against the plurinominal senate seats of former governor Javier Corral, from Morena, and Ricardo Anaya and Lilly Téllez, from the PAN.
The cherry-colored party claimed that both PAN members were not eligible. It alleged that the first was a fugitive from justice and lived in the United States and that the second did not have an honest way of living.
The magistrates of the upper chamber dismissed these allegations and confirmed the two seats for the fraction blue and white, which will be made up of 22 legislators.
In the case of Anaya, the draft sentence, led by Janine Otálora, considered that Morena does not expose concrete arguments to support
his sayings.
And in the case of Téllez, who will repeat as senator, the TEPJF stated that there is no basis to declare her ineligible.
The same was determined for Corral, who was challenged as ineligible for having an arrest warrant against him from the Chihuahua State Prosecutor’s Office and thus being considered a fugitive from justice.
However, the plenary session of the upper chamber ratified the decision of the INE and awarded the seat to the former president.
In yesterday’s session, the five judges unanimously decided to dismiss the 8,528 lawsuits filed by parties and citizens, lacking legal and legitimate interest
The court based its decision on the fact that the electoral law establishes that only parties or candidates can challenge the allocation of the 200 federal proportional representation seats.
