The Judiciary annuls the retirement of the former general commander of the Police, Jorge Angulo

Last minute. The Judiciary Branch (PJ) declared null and void the resolution that terminated the designation of Jorge Angulo as General Commander of the Police and announced his retirement.

This came after the former police chief himself sued the Ministry of the Interior (Mininter) and the Presidency of the Council of Ministers (PCM) for the arbitrary and illegal act against him.

Evaluating all the arguments presented by both sides, the PJ decided to “partially declare” the plaintiff’s request “founded because the violation of his rights had been proven.”

The affected rights would be those of “due administrative procedure (due process), due justification and motivation of the resolutions,” said the governing body of Justice.

Therefore, “Supreme Resolution No. 019-2024-IN dated January 22, 2024, which resolved to terminate the plaintiff’s appointment to the position of Commander General of Peru“.

In turn, “it is decided to transfer him from active status to retired police status, with the defendant entity having to issue a new administrative act (Supreme Resolution) within the (appropriate) period.”

Finally, the PJ declared the request regarding reinstatement to the “activity as General Commander of the PNPwith all corresponding prerogatives, with costs of the process.”
