The decision was handed down last week by the Special Court, which rejected a request from the PSOL to remove the councilor from office. The case reached the STJ in March of this year after the arrest of Domingos Brazao.

According to the ministers, the criminal charges against Brazão are not related to crimes of responsibility, conduct that is investigated in impeachment cases.

Domingos Brazão, his brother, Chiquinho Brazão, federal deputy (No Party-RJ), the former head of the Civil Police of Rio de Janeiro Rivaldo Barbosa and the major of the Military Police Ronald Paulo de Alves Pereira are defendants in the Supreme Federal Court (STF) accused of acting in the murder of Marielle Franco and the driver Anderson Gomes.

Earlier, the Ethics Council of the Chamber of Deputies approved the opinion calling for the impeachment of Chiquinho Brazão.

The deputy’s defense has five business days to appeal to the House’s Constitution and Justice Committee (CCJ). For the parliamentarian to lose his mandate, the opinion still needs to be approved by the House’s plenary.
