The judge declared the case complex and pointed out that the enacted law goes against the Vienna and Palermo conventions, and that it has several gaps that lead to the interpretation of the judges.
Specifically, Chavez explained that international treaties are part of domestic law, as established by the Constitution, and judges are therefore obliged to comply with them.
He pointed out that the approved new organized crime law is not inaccurate in some parameters and that it should be analyzed according to the criminal types of each consideration.
The judge also pointed out that the promoter of this law by which the case is to be shelved – Waldemar Cerrón – has tried to take advantage of this norm, since he is included in the investigation.
Victor Peralta, the Cerrón family’s lawyer, said he would appeal this decision within three days.

Criminal lawyer Andy Carrión said that Judge Chávez applied the new law, although based on conventions and criteria of interpretation.
“The judge’s decision was appropriate. What Chavez has decided is interesting because it is not that he has not applied this new rule reformed by Congress, but that he has applied it, but in accordance with what the international conventions indicate, basically the Palermo Convention and also what the Constitution indicates. With what he has said: yes, I am going to apply this rule, but with interpretative criteria, such as the value market, the economic purpose, the interpretation of what the Convention indicates. That is why he has said that even with this new law, the conditions of criminal organization are met and, therefore, he cannot protect the resources of the Cerrón brothers,” he explained to Peru21.
