Both defendants turned themselves in to the Homicide Department of the Prosecutor’s Office to answer for the alleged crime, after a call made to them by the police authority, therefore the authorities executed arrest warrants number 2024-AJ0013944 and 2024-AJ0013947 against them.
Judge Yeritza Cabral de la Cruz, of the Judicial Office of Permanent Attention Services, therefore ordered the defendants to be held in preventive detention for three months.
Background
In its preliminary investigation into the events, the results of which are presented in the request for coercive measures, the Santiago Prosecutor’s Office establishes that the victim Nicasio Reyes and the defendants had an argument, which later ended in fistfights between the victim and the defendant Alejo Hernández, who took a knife and injured Nicasio Reyes.
This first incident, triggered by a labor dispute, continued when the victim, injured by Alejo Hernández, fled to a grocery store in the aforementioned area and returned to the place where the fight took place.
The accused were waiting for him there, each carrying a knife in their hands, they pounced on him and caused the injuries that later caused his death.
In addition to the knives collected at the scene, the Physical Violence Department (Homicide) of the Santiago Prosecutor’s Office, coordinated by prosecutor Yeilín Durán, has among its evidence images captured by video surveillance cameras, in which the details of the homicide were recorded; it also has in its possession the clothing that the accused were wearing at the scene; the testimonies that account for what happened, and the forensic autopsy report number 470-2024, which certifies the expertise on the victim’s body, which was stabbed multiple times.
Provisionally, this prosecuting body charges Nicasio Manzueta and Alejo Hernández with violating articles 265, 266, 295 and 304 of the Dominican Penal Code, which typify criminal association and homicide to the detriment of Nicasio Reyes.
