The prosecutor Jose Domingo Perez He insisted on his request to the Judiciary to order the Public Prosecutor’s Office to cease an investigation into him for the alleged crime of illicit enrichment.
According to RPP, the judge appealed the ruling issued by the Third Higher Court of Preparatory Investigation on April 26, in which it declared a protection of rights unfounded.
In his appeal, prosecutor Pérez Gómez stated that this resolution violated due process, in accordance with the principle of ne bis in idem (you cannot be tried twice for the same crime) and the principle of procedural legality.
Domingo Pérez argues that the resolution violates due process by infringing the principle of prohibition of multiple criminal prosecution and the principle of procedural legality. Therefore, he requests that the appealed resolution be partially revoked and that the senior prosecutor in charge of the investigation be ordered to cease the multiple criminal prosecution against him.
The Permanent Criminal Chamber of the Supreme Court has decided to admit the appeal of prosecutor Domingo Pérez, considering that it meets the objective and subjective requirements necessary to be accepted.
The court, presided over by Supreme Court Judge César San Martín, has scheduled a hearing to evaluate the appeal and issue a decision as soon as possible.
