The Attorney General summons González Urrutia for publishing electoral records

Anzoátegui prosecutor arrested for refusing to prosecute four people arrested in protests

The Attorney General of the Republic, Tarek William Saab, assured on August 23 that in the “next few hours” he would summon presidential candidate Edmundo González Urrutia for allegedly having “a“surpassed the quality and competence of the Electoral Power”

The Attorney General’s Office summoned opposition presidential candidate Edmundo González Urrutia to appear before the Public Ministry (MP) next Monday, August 26 “for the publication of forged documents through the website www.resultadosconvenezuela.com«, the entity noted on its Instagram account.

According to the document, the summons is part of the investigation into the alleged crimes of “usurpation of functions, forging public documents, instigation to disobedience of laws, computer crimes, criminal association and conspiracy” related to the publication and maintenance of the web portal in which the opposition led by María Corina Machado released the voting records collected by its witnesses, according to which González Urrutia had emerged as the winner with 67% of the votes.

The Attorney General appointed by the 2020 National Assembly, Tarek William Saab, reported on Friday, August 23, that “in the next few hours” the opposition member González Urrutia would be summoned to “give statements regarding his authorship of the page that has usurped the quality and competence of the Electoral Power.”

On August 22, the Supreme Court of Justice (TSJ) validated the results issued by the National Electoral Council (CNE) on July 28, which gave victory to President Nicolás Maduro. During the reading of the sentence, they assured that they would send information concerning the MP so that they could advance their investigation into the publication of minutes by the opposition.

“We are making use of all the corresponding legal resources and unequivocally abiding by the ruling of the TSJ to move forward and delve deeper into these investigations that will have results and we will announce them at the appropriate time,” said Saab in his statement that day after the TSJ ruling.

Irregularities in the summons of the Prosecutor’s Office

Following the publication of the summons on the MP’s Instagram account, lawyer Zair Mundarain pointed out some considerations regarding the summons made to González Urrutia.

1. The summons does not indicate the procedural quality as required by the doctrine of the Public Prosecutor’s Office.

2. Edmundo Gonzalez does not pYou can know if you are a defendant or a witness.

3. They summon him for an interview. This is NOT possible in the case of defendants, since they only make a statement if they wish to do so, in accordance with the provisions of the Constitution.

4. The citation must refer to some facts. In this confusing text there are no facts or dates that would help us to know what it refers to.

5. The summons is not to a prosecutor’s office, but to the 15th floor where Tarek William Saab’s office operates.
