The President of the Chamber of Deputies, Arthur Lira (PP-AL), forwarded this Friday (16) for analysis by the Constitution and Justice Committee (CCJ) the Proposed Amendment to the Constitution (PEC) No. 8/2021, which limits monocratic decisions in the Federal Supreme Court (STF) and in other higher courts. The PEC was approved in the Senate in November last year and was waiting for the start of processing in the Chamber.
After passing through the CCJ, the proposal will have to be approved in two rounds in the plenary of the Chamber.
PEC 8/2021 prohibits single-handed decisions that suspend the effectiveness of a law or normative act with general effect, or that suspend acts of the Presidents of the Republic, the Senate and the Chamber of Deputies. Single-handed decisions with the power to suspend the processing of legislative proposals that affect public policies or create expenses for any Branch are also prohibited.
Monocratic decisions are those made by just one judge. This is a provisional decision that needs to be confirmed by all the ministers of the Court.
This morning, the STF confirmed the provisional decisions of Minister Flávio Dino, which suspend the execution of different types of amendments made by parliamentarians to the Federal Budget, including individual and state bench amendments, whose execution would be mandatory. The so-called “Pix amendments” were also suspended, which allow direct transfers to states and municipalities by individual indication of a parliamentarian without the need to link the funds to a specific project, program or agreement.
