Senate approves PEC that forgives fines of political parties

The Federal Senate approved this Thursday (15), in two rounds, the Proposed Amendment to the Constitution (PEC) that establishes new rules for political parties in the application of resources destined for racial quotas in candidacies.Senate approves PEC that forgives fines of political parties

The call Amnesty PEC (9/2023) It also forgives the debts of parties that failed to comply with the minimum allocation of resources to black and brown candidates in past elections and allows the renegotiation of tax debts of parties.

According to the proposal, for the parties’ fines to be effectively cancelled, the amounts must be invested in black and brown candidates in the four elections to be held from 2026 onwards.

The approved text determines that political parties must allocate 30% of the resources from the Electoral Fund and the Party Fund to the candidacies of black and brown people, starting with this year’s elections. The rule may end up reducing the funds for these candidacies, since, currently, the expenses must be proportional to the number of black candidates, that is, if 50% of the candidates of a party are black, the resources for these candidacies must also be 50% of the total.

The text, analyzed today in two rounds by senators, will now be enacted by the National Congress. Since it is a Proposed Amendment to the Constitution, it does not require presidential sanction.

Debts

According to the PEC, parties will be able to pay off social security debts in up to 60 months and other debts in up to 180 months.

The text provides that parties, their institutes or foundations may use resources from the Party Fund to pay fines and other sanctions for non-compliance with electoral law and non-electoral debts.
