Leopoldo Munera Ruiz will remain the rector of the National University of Colombiathis after the Council of State deny a request for provisional suspension of the administrative act of appointment of the teacher and lawyer for this position.
This decision was ratified by the orders of August 1 and 8 of this year, according to a statement issued by the main public higher education institution (IES) of the country.

However, the Council of State admitted a couple of new lawsuits against his appointment as a senior manager of this academy.
“That is to say, these electoral nullity processes are carried out in such a way that the sentence will decide on the legality of the election that is being requested to be annulled.“, the Council of State stated, in information compiled by the National University.

In both legal documents it is stated that “It should be noted that, in the processing of this matter, the CSU (Higher University Council) of the UNAL reported that the majority of its members (5 out of 7) refuse to decree the required precautionary measure.“.

“In the two accepted claims, the electoral judges will exclusively analyze the legality of the minutes no. 10, of the extraordinary session of June 6, 2024, and Resolution no. 068 of 2024 because they are the only ones that can be annulled in this type of electoral nullity control claims.“, the press release states.
Nevertheless, “The same does not occur with respect to Resolution No. 067 of 2024, of the CSU of the UNAL, since through this act it was not resolved to appoint the defendant as rector of the UNAL.“.

For the Fifth Section, in the second admitted claim, “The objections set forth in the complaint do not lead to declaring the provisional suspension requested because this is not the instance to rule on the effects of the decisions adopted in Resolution 067 of 2024, and its influence on the appointment of Leopoldo Alberto Múnera Ruiz as rector of UNAL”.

In the most recent lawsuit, the plaintiff, the Senator Paloma Valenciastated that there was a breach of the provisions of the regulatory framework of the National University, but the Council of State “could not establish which normative sections it refers to, since the plaintiff did not expressly refer to the arguments raised in the claim.”.
