In an extraordinary session that lasted two hours, the request for the vacancy of the mayor of the Alto de la Alianza district in Tacna, Demetrio Cutipa Vilca, was not processed.

The session was held in the council chamber with the presence of the seven councillors and residents, for and against, who were awaiting the decision of the plenary session.
Argues illegal appointment
The promoter of the vacancy, José Luis Yanapa Jarro, was represented by lawyer Mauricio Alarcón, who pointed out that the request is based on “an arbitrary and illegal appointment, which is also being investigated by the Anti-Corruption Prosecutor’s Office.”
He explained that the position of municipal manager is exclusive and therefore is not compatible with a position in another sub-management, according to Article 27 of the Organic Law of Municipalities.
He accuses that he does not fit the profile
He pointed out that manager Lorena Silva Cifuentes was appointed by Mayoral Resolution 08-2024, but additionally holds the position of deputy manager of human resources.
She added that according to the Servir Law, certain requirements are required to occupy the position of municipal manager, such as having experience in similar positions, something that is not noted in the official’s file. Finally, she assured that she has a position in the private company Cantaritos, according to Sunat, despite the fact that the job of municipal manager is exclusive.
Vacancy cause is not met
Mayor Demetrio Cutipa Vilca was represented by his lawyer Jorge Infantas Franco, who clarified that the request is based on the cause of “contracting restrictions”, framed in numeral 9 of Article 22 of the Organic Law of Municipalities, in accordance with Article 63.

“This case deals with contracts, it never deals with designations. For there to be a contract, there must be two parties, for example, one that sells and another that buys. On the other hand, a designation is something unilateral. In this case, this issue is being dealt with in the criminal sphere,” he said.
Tie in the vote
He explained that the three elements that constitute a case of irregular contract, such as the interested participation of the authority or the existence of a conflict of interest, are not met, and therefore the vacancy is not admissible.
At the time of the vote, Barbarita Salas Pinto, Juan Larico Huanca, Jennifer López Sandoval and Henry Choque Mamani voted in favor; while Silver Choquepata Quispisayhua, Juana Cruz Chambilla, Alex Araujo Alvarado and Mayor Demetrio Cutipa voted against. The mayor’s vote was observed by lawyer Alarcón, who announced that he will consult the JNE.
Mayor cried with followers
The townspeople who watched the session from the windows and the screen of the hall launched harangues for and against. The mayor went outside to greet his followers, even crying, saying that they were trying to unfairly remove him.
