Dino requests documents that authorized payment of amendments

Minister Flávio Dino, of the Federal Supreme Court (STF), decided this Thursday (8), in Brasília, that the ministries must send the Court documents on the payment of parliamentary amendments of the RP8 type, one of the modalities that are part of the so-called “secret budget”.Dino requests documents that authorized payment of amendments

The measure was taken by the minister to verify the indications and requests for prioritization of transfers of amendments from deputies and senators.

Last week, the minister’s office held a meeting with representatives from the Senate and the Chamber of Deputies to comply with the decision that determined transparency measures in the transfer of amendments.

During the meeting, the representatives claimed that they would have “difficulty finding documents” to comply with the decision. Therefore, the minister determined that the Executive Branch, which makes the transfers, must send the requests made by the parliamentarians to justify the payment of the committee amendments.

Committee amendments

“Therefore, aiming to meet the deadlines defined in the technical meeting held on 08/06/2024, I determine that the Executive Branch, through consultation of the AGU with the ministers of State, forward to the rapporteur all letters related to indications or prioritization by the authors of RP 8 (committee amendments), in the current fiscal year”, decided the minister.

According to Flávio Dino’s decision, the Federal Court of Auditors (TCU) must also send to the Supreme Court, within ten days, a copy of all ongoing proceedings regarding irregularities in the rapporteur’s amendments.

In December 2022, the Supreme Federal Court ruled that the amendments known as RP9 are unconstitutional. Following the decision, the National Congress approved a resolution that changed the rules for distributing resources through rapporteur amendments to comply with the Court’s ruling. However, the PSOL party, which filed the lawsuit, ruled that the decision continues to be violated by means of the RP8 amendments.

Pix amendments

Earlier, in another decision on parliamentary amendmentsthe minister maintained the suspension of the so-called “Pix amendments” to the Union Budget.

The decision was motivated by an action filed by the Attorney General of the Republic, Paulo Gonet.

In the decision, the minister understood that the execution of the amendments can continue in cases of ongoing works and public calamity. The release of funds is subject to compliance with transparency and traceability requirements.
