The Technical Secretariat of the Consumer Protection Commission No. 3 of Indecopi announced that it has initiated a preliminary investigation into Banco de Crédito del Perú (BCP) due to the failure of its systems on July 30 that prevented the use of its payment channels.
The purpose of this measure is to assess indications of violations of the Consumer Protection and Defense Code. In the event of indications of alleged violations of the aforementioned regulation, the Commission would begin an administrative sanctioning procedure, and if violations are verified, it would imply the imposition of sanctions and corrective measures in favor of those affected.
In this regard, Indecopi urges companies to take the necessary actions to reduce the occurrence of errors or operational defects in their systems, or if this occurs, to clearly inform users about them.
“Any circumstance that affects the information and availability of the funds in the accounts, as well as the normal use of the contracted services could be considered a violation of the duty of suitability that suppliers are obliged to guarantee.“, Indecopi said.
On the other hand, regarding the operational failures in Interbank’s systems in September 2023, which would have affected the available balances in its clients’ accounts, they announced that the Commission issued a statement as the first administrative instance in April of this year and will be evaluated by the Specialized Chamber for Consumer Protection (SPC) as the second and last administrative instance.
In addition, regarding the complaints of Interbank users regarding the decrease in their account balances that occurred on May 4, 2024, Indecopi reported that, through the Technical Secretariat of the Commission, and after concluding the respective preliminary investigation, an administrative sanctioning procedure will be initiated against said banking entity, for the alleged failure to comply with the duty of information and suitability.
