Although the law prohibits it, the Congress granted Alberto Fujimori access to a lifetime pension for his period as head of State (1990 – 2000). Now, he will receive S/15,600 monthly, a payment that will be made despite the fact that he owes S/57 million in civil reparations to the Peruvian State. For this reason, specialists considered that the Attorney General’s Office could embark on this economic benefit.
However, before such an analysis, it is necessary to clarify the reasons why Fujimori should not receive a life pension. Article 2 of Law 26519 establishes that this remedy cannot be granted to a former president who has been constitutionally accused and, in that context, is found guilty of committing a crime.
In the specific case of Alberto FujimoriOn November 30, 2000, Congress filed a constitutional complaint against him for a series of crimes for which he was subsequently found guilty.
Life pension should be seized, according to specialists
Criminal lawyer Andy Carrión considered that the decision of Congress is illegal, since the pardon granted to Fujimori by the former president Pedro Pablo Kuczynskiand recently ratified by the constitutional Court In 2023, the sentence will only be extinguished but the sentences against him will not be annulled (for the deaths in Barrios Altos and La Cantuta).
For this reason, the specialist indicated that the monthly payment should be used to pay the civil reparation he owes. “He will receive 15,600 soles per month. What the Attorney General’s Office can do is seize or request the seizure of these monthly bills that he receives to pay for the civil reparation,” he told Exitosa.
In the same way, the Former Attorney General José Ugaz He supported the legal basis that prevents the leader of Cambio 90 from receiving more than S/15,000 per month. “He is a former public official who is legally unworthy and, therefore, the State cannot recognize any right that someone who has fulfilled his function without defrauding the State could have had or has by exercising his position,” he explained.
Along these lines, Ugaz stressed that The former president has an outstanding debt of 57 million soles for civil compensation and that any economic benefit granted to him would be seized.
“(Alberto Fujimori) has a multimillion-dollar debt, so, in the event that any economic right is denied, it would have to be seized to cover the amount of civil compensation,” he concluded.
On the other hand, Carrión explained that the pension granted to Fujimori will be a precedent for Pedro Castillo or Alejandro Toledo to request this monthly payment again. “Despite the fact that they have been the subject of a constitutional process of accusations, they are not entitled to this benefit. Of course, since they do not have parliamentary representation and the only one who does is former President Fujimori, then the interpretations are not homogeneous either. If you grant it to Fujimori then you also have to grant that benefit to others.”
