The lawyer of Alberto Fujimori, Elio Riera, He indicated in relation to the payment of the former president’s life pensionthat there are two positions: ethics and law. He stated this during an interview with the media outlet Exitosa, where he also stated that according to the law, his client has no constitutional accusation that prevents him from receiving the aforementioned remuneration.
“The pension is suspended while there is a valid constitutional accusation. We have any constitutional accusation in force today, we do not have it, there is no constitutional accusation, so what is the identification parameter for the pension? Today or when the former president was convicted?” he said.

According to Elio Riera’s arguments, the only way for Fujimori to be unable to access the life pension is for Congress to bring a constitutional charge against her and for her not to be declared innocent by a court ruling.
“As of today, does the former president, the first paragraph of the law, have any constitutional accusation? None. It should be suspended, none, so the second part does not apply,” he said.
Along those lines, as explained above, Fujimori would be eligible to receive a lifetime pension for the monthly amount of S/15,600. “First, because it is regulated by law and therefore if the law allows it, it is not illegal, it is correct and appropriate. And point number two (…) I consider it to be a fundamental right (…) they have a primordial order,” Riera specified.
It should be noted that the human resources department of the Legislative Branch declared Alberto Fujimori’s request as admissible after collecting the conclusions of the Legal and Constitutional Office.

In the same interview, lawyer Elio Riera commented that the former President of the Republic will use the money from his life pension to cover the civil reparation of S/57 million that it owes to the Peruvian State.
However, he mentioned that while the debt payments are being made, his defense will continue to await a court decision regarding their requests to annul the lawsuits against them.
“My job as a lawyer, once this request has been obtained, is to find a solution regarding civil compensation and, as such, to await the court’s rulings because I have requested its annulment,” he said.
