Special commission says draft criminal code is modern; refutes detractors

The advances and benefits of the legislative proposal were presented at the Corripio Communications Group’s Weekly Lunch by the Special Commission of the Chamber of Deputies appointed to study it, chaired by the legislator Alexis Jimenez.

In refuting the questions of legal experts, the congressman assured that the document has been duly analyzed and socialized with various sectors of society.

After assessing that it is a project with content in line with the new times, the deputy of the Modern Revolutionary Party (PRM) for the province of Santo Domingo, he added that it includes criminal types that are not contemplated by current legislation, such as contract killing, cybercrime, pyramid schemes, fraud, illegal occupation or invasion of land, collusion of officials, counterfeiting of medicines, adulteration of beverages and identity theft.

Likewise, crimes against humanity, genocide, forced disappearance of persons, femicide, damage caused by chemical substances (devil’s acid), torture or barbaric acts, harassment or bullying, non-consensual sexual activity, abandonment of infants, injury or death by biomedical experiment are classified. non-consensual and reckless shooting.

Other punishable acts include illegal arrest, self-kidnapping, spreading false information, violation of privacy, violation of residence or domicile, telephone disturbance, disclosure of secret information, violation of correspondence and illegal manipulation of genes.

The new code also includes burial and desecration of corpses, trade in stolen goods, collective fraud against the State, violation of the right to recall when a person is arrested, violation of domicile by a public authority and the statute of limitations for acts of corruption against public property (article 328). Regarding the latter aspect, the current statute of limitations expires after 10 years and was increased to 20 years.

The president of the special commission of the Penal Code participated in the Corripio Communications Group Lunch, accompanied by his colleagues Rafaela Alburquerque, Jose Horacio Rodriguez, Ramon Bueno and Jesus Manuel (Sandro) Sanchez, who are also part of the commissioners who studied the piece. In addition to them, the legislative advisor Francisco Franco.

According to Jimenez, more than one hundred people and institutions participated in the public hearings held on July 15. Other recommendations were then submitted in writing, and to date they have been recorded more than 150 proposals.

“The variety of opinions expressed by Dominican society in the public hearings regarding the reform of the code reflects a high level of interest among citizens in an issue that is so crucial for the country,” he said.

In making a chronology of the passage of the project through his hands, the legislator of the governing party specified that on July 16, the Special Commission proceeded to make a comparative matrix of the three initiatives of which it was empowered; initiative No. 11466-2020-2024-CD, whose proponents are Senators Rogelio Genao, Alexis Victoria Yeb, Dionis Sánchez, Martín Nolasco Vargas and Virgilio Cedano Cedano; initiative No. 11451-2O2O-2024-CD, authored by Deputies Magda Rodríguez and José Horacio Rodríguez; and No. 11159-2020-2024- CD, submitted by Rafaela Alburquerque and Sadoky Duarte.

“The commission analyzed the three projects, reflecting its dedication and commitment, as it worked for long hours in meetings to thoroughly review the projects and proposals presented by citizens,” he said.

He recalled that later, due to the number of proposals, the Commission decided to request the Plenary of the Chamber of DeputiesIt was a six-day extension, in accordance with Article 148 of the internal regulations, which was approved unanimously. All the articles were analyzed, with special emphasis on those where there were differences and proposals, he added.

It is recalled that the Senate of the Republic approved the project in two readings and sent it to the Chamber of Deputies, where it was approved in the first reading and then sent to a special commission.
