Santo Domingo, DR.- By decree No. 403-24 of July 24, 2024, President Luis Abinader established this Monday the regulations for the application of the Law 34-23 of Care, Inclusion and Protection for People with Autism Spectrum Disorder (ASD).
With the regulation, the Dominican Government seeks to make the aforementioned Law effective, by organizing the powers of the State entities and bodies; in addition to creating spaces for inter-institutional coordination promote, protect and ensure the rights in favor of people with this condition.
The regulation establishes that administrative entities and bodies can develop support programs to people with TORCH, in compliance with institutional objectives and programs, as well as public and private companies, as long as the volunteer initiatives do not involve any economic benefit.
It also regulates the administrative procedure for the application of the administrative sanctions, For this purpose, it relies on the principles and rules contained in Law 107-13, of August 6, 2013, on the Rights of Persons in their Relations with the Administration and Administrative Procedure.
For the preparation of this regulation, technical-legal work was carried out with the public institutions linked to compliance with Law 34-23, which allowed strengthen the regulatory piece in a transversal manner.
In turn, a consultative process was carried out with civil society, with the aim of receiving their suggestions and/or comments.
This process of preparing the Implementing Regulations of the Law 34-23 has been carried out in accordance with the guidelines of the Convention on the Rights of Persons with Disabilities, ratified by the Dominican State in 2008, on the understanding that: “persons with disabilities must have the opportunity to actively participate in decision-making processes on policies and programs, including those that directly affect them.”
This new regulation complements the constitutional protection for vulnerable people, such as those with Autism Spectrum Disorder (ASD).
About Law 34-23
On June 5, 2023, President Luis Abinader signed into law the Law on Care, Inclusion and Protection for People with Autism Spectrum Disorders (ASD), numbered 34-23.
This law aims to regulate the care, protection and full and effective inclusion in society of people with ASD, through the protection and guarantee of their rights and the satisfaction of their needs.
