In the midst of new demonstrations in the north against migrants, following the death of a truck driver at the hands of three Venezuelans who are detained in Antofagasta, and after the Comptroller General of the Republic took note of the regulations of the Migration Law, the Official Gazette finally published the new legislation; the same day that the Minister of the Interior, Rodrigo Delgado, will travel to the area.
The law is made up of 183 articles and with its publication it was ready to enter into force.
As stated emmolarticle 1 establishes that “this regulation is intended to regulate matters related to the entry, stay, residence and exit of foreigners from the country, as well as the exercise of their rights and duties, in harmony with the principles and regulations in force regarding migration.

Likewise, in article 2 it is stipulated that “the State must urge for a safe migration, manifested in the actions tending to prevent, repress and punish the illicit smuggling of migrants and the trafficking of persons, and will in turn ensure the persecution of those who commit these crimes, in accordance with the legislation and international treaties ratified by Chile on the matter and that are in force”.
Another article clarifies that “the entrance of people to the national territory and the exit from it must be carried out through authorized steps, with suitable travel documents and provided that there are no legal prohibitions in this regard.”
And there is an article that defines that “expulsion is the measure imposed by the competent authority consisting of decreeing the forced departure from the country of the foreigner who incurs in any of the causes provided for in the law for his origin. Expulsions can be decreed by the corresponding administrative authority, that is, the Undersecretary of the Interior or the Director of the National Immigration Service, as appropriate; or by the competent Court: in accordance with the rules contained in Law No. 18,216, which establishes penalties indicated as substitutes to custodial or restrictive sentences of freedom, and in general in the applicable regulations”.
The Minister of the Interior, Rodrigo Delgado, will arrive this Saturday in the Antofagasta Region in the context of the crisis that is being experienced in the area and in the midst of the mobilizations of truckers and unions.
