The Executive Directorate of the National Commission for the Defense of Competition (Pro-Competition) reported that it ordered an investigation of a complaint filed by the commercial company Tecnimédica, SRL, against seven economic agents.
It does so in response to the alleged commission of acts of unfair competition that would constitute an infringement of the General Law for the Defense of Competition 42-08.
In accordance with resolution DE-002-2022, of February 1, the agency has ordered the initiation of an investigation procedure against the economic agents Antonio Daniel Insfran Maldonado, Mercedes Valdez, Nelsy Mateo, Dominican Medical Technology (Tecmed), Esencia VIP Aesthetics, Cecamed, SRL, and Faceglow Stetic Center and Spa, SRL.
The investigation procedure has been initiated by virtue of the existence of facts that constitute reasonable indications to presume the performance of acts of deception and acts of confusion by the accused. The alleged unfair competition in the form of acts of imitation was dismissed by the Executive Directorate. The complaint filed on December 16, 2021 by the complainant before ProCompetencia is based on alleged acts of deception, confusion and imitation, configured in article 11, literals a, b and d, of Law 42-08.
