The Buenos Aires Contentious, Administrative and Tax Court 15 granted an injunction filed by a neighborhood organization of Caballito and ordered the Buenos Aires government to suspend the works of the linear park on Honorio Pueyrredón Avenue.
The measure was ordered by Judge Víctor Trionfetti after the environmental appeal raised weeks ago by the SOS Caballito association regarding the work that foresees the closure of half of the lanes of Honorio Pueyrredón to transform the place into a linear park.
in failure, The judge asks the Buenos Aires authorities to “communicate” the suspension to the winning company of the road tasks and requests that it “adopt the necessary measures to maintain road and pedestrian safety, if necessary, due to the existence of possible construction sites, fences, materials or machinery”.
At another point, the magistrate instructs “both the Executive Branch and the Communal Board of Commune 6 of the Autonomous City of Buenos Aires, convene a Thematic Public Hearing regarding the change of use in the public domain and the environmental issue”.
“At this point, I believe that the right of access to information and public participation must be guaranteed in a precautionary manner with respect to the pertinent conventional and legal norms, and a public hearing must be held,” he stressed.
On the other hand, he argued that “There remains the issue of the absence of a law that approves the modification of the road that transforms a part of Honorio Pueyrredón street into a street of coexistence. That requirement, it is not my interest to satisfy or order it”.
The project
It was announced in September 2021 by the Buenos Aires administration to take half of the lanes of Honorio Pueyrredón Avenue, which run south-north, to create a “coexistence street” that adds vegetation and recreation areas.
But nevertheless, the neighbors oppose what they consider the “destruction” of the avenue and they propose, as an alternative, the creation of a green space in the area of the railway yard, located a few blocks from the place where the work is carried out, which could have an area of 15 hectares.
In this context, they made several claims, which included marches in the Cid Campeador area and the intersection of Acoyte and Rivadavia avenues, as well as in the area of road works.
