A man who was found guilty of committing sexual abuse of children, of which his stepdaughter was a victim.
The complaint had been filed with the Public Ministry when Law 3440/08 was in force, which stipulated meager penalties for this type of punishable act. Subsequently, this situation changed with the modifications registered in Law 6002/17 that provide more severe sanctions for this type of crime.
After analyzing the final arguments of prosecutor Alcides Corvalán, the Sentencing Court, presided over by Judge Fabián Escobar and made up of judges Sandra Farias and Carlos Hermosilla, ordered the sentence of 3 years in prison for the defendant. The Court took into account as mitigation that there was no intercourse, that the defendant did not have a judicial record and that he made himself available to justice at all times during the process.
The background of the case indicates that the couple had lived together for several years and lived in the same house with the little victim, the result of a previous relationship of the complainant. The events occurred since approximately 2012, when the defendant groped his stepdaughter when the girl was 8 years old.
