The Superior Court of Brazil decided this Tuesday night that the trial against actor Juan Darthés in the case of abuse against Thelma Fardín, allegedly committed during a theatrical tour in Nicaragua, did not fall under federal jurisdiction, for which resolved that the cause “return to zero pages”after having declared several witnesses and being the debate in its final part, the actress denounced in social networks.
The actress Thelma Fardín, through her Twitter account and reproduced on the Instagram of the Actrices Argentinas collective, highlighted that “the message today-after this ruling- is impunity“.
“I traveled to Nicaragua and there they said that he had to be judged. Brazil decides that it has jurisdiction and after listening to me decides that it does not have jurisdiction. This means a level of violent re-victimization“, remarked the actress.
Fardín stressed that the message “It is a scandal, it is of an enormous level of impunity, since three public prosecutor ministries from three different countries collaborated in this trial. International women’s movements intervened so that this case reaches Justice“.
“They ask us women to go to court and she says this outrageous. If this happens in a case like mine, what remains for the rest of the women who decide to go to court,” he said.
For Fardín “this is very rare” and reveals “To what extent does the power and influence reach so that in a trial that has begun and in its final stage this ruling is reached. Obviously they do not want to be judged because the evidence is very convincing. We went to Justice and they say this bestiality, that everything done so far is useless“.
Fardín announced that he will take the case to the Supreme Court “who has a history that these types of crimes are prosecutable in the Federal Justice” of Brazil and added: “We are going to continue insisting that Justice listen, this does not end here, I am tired but not defeated.”
For his part, Juan Darthés’ lawyer, Fernando Burlando, assured on the América TV channel that “impatience generates this type of situation” (in relation to the accusing party).
“I think that this also hurts Darthés, it hurts everyone. One of the parties can appeal and the higher court, the Chamber of São Paulo, must resolve, which takes its time,” he said.
Burlando explained that the judge who had this issue “cannot play a single role until justice decides, because he was declared incompetent by the superior judge and stressed that the trial should start again.”
Last December 1, Judge Mazloum, of the São Paulo federal criminal jurisdiction, had postponed the hearings with rounds of witness statements, because the São Paulo judicial system went into recess from December 17 until January 6.
The trial that was taking place in São Paulo, with the accusation of federal prosecutor Andrey Borges Mendonça, had been delayed by the extension of the testimony of three witnessesamong them Calu Rivero, who declared on December 1 from the Argentine consulate in Rome virtually.
Fardin denounced Darthés together with the Actrices Argentinas collective on December 11, 2018 for sexual abuse that occurred in Nicaragua when she was 16 years old and he was 45, during a tour of the television strip “Patito Feo”.
Juan Rafael Pacífico Dabul -real name of Darthés-, was born in Brazil, the country where he moved in 2019 to avoid being arrested for the arrest warrant distributed by Interpol.
