The Superior Court of Justice (STJ) decided to annul the evidence of a lawsuit against drug dealer André Oliveira Macedo, known as André do Rap. He is accused of international drug trafficking and of being one of the leaders of a criminal faction that operates inside and outside Brazilian prisons.
In a decision handed down yesterday (11), the Sixth Panel of the Court decided to annul the evidence obtained on the understanding that the arrest warrant against the trafficker did not authorize the search and seizure carried out during the operation.
According to the understanding formed by the majority of justices who participated in the trial, only the seizure of personal belongings that were with the accused during the time of execution of the arrest warrant can be carried out.
André do Rap has been on the run since 2020, when former Minister of the Federal Supreme Court (STF) Marco Aurélio Mello granted a habeas corpus to the investigated. Then, the decision was overturned by the plenary, but the drug dealer had already fled the country.
