After the murder of the first corporal of the Carabineros, the Government promulgates the Naín-Retamal Law while Approving Dignity announces that it will desist from going to the TC

From the Montt Varas room of the La Moneda Palace, President Gabriel Boric promulgated Law 21,570, better known as Naín-Retamal, which seeks to strengthen and protect the exercise of the Chilean police and Gendarmerie functions.

The foregoing occurs in the context of the murder of the first corporal of the Carabineros, Daniel Palma, who died after receiving a ballistic impact to his head in the middle of a police control in the commune of Santiago Centro, Metropolitan region.

In a reserved manner, the President also confirmed the processing of three other initiatives aimed at combating the current situation of delinquency and organized crime in the country. Among them, the one that reinforces the powers of the Gendarmerie and creates the crime of extortion, and the one that modifies the Penal Code to aggravate the penalty for the crime of kidnapping.

Likewise, the Head of State, together with the Minister of the Interior, Carolina Tohá, and the head of Justice and Human Rights, Luis Cordero, endorsed Law 21,556, which increases the penalty for the crime of carrying weapons in highly crowded places.

Now, all that remains is that for the initiatives to become Law of the Republic, the Comptroller’s Office takes account of the promulgating decrees. Once this procedure is completed, the administrative acts will be published in the Official Gazette, in order to enter into force.

On the other hand, from the Government they affirmed that the promulgation of the law that would strengthen the prosecution of drug trafficking and organized crime could not be finalized. This, since opposition parliamentarians filed a request before the TC to challenge an article of the regulations on the medicinal use of cannabis.

During the day of last Wednesday, and in the middle of a harsh debate, the Chamber of Deputies and Deputies endorsed the Naín-Retamal Law. After being approved, sectors of the ruling party had stated that they would take the initiative to the Constitutional Court (TC)

In this sense, the deputy Catalina Pérez (RD), declared on TVN on Thursday morning that from Approved Dignity they will not go to the TC to challenge some articles of the Naín-Retamal Law. This, as a result of the decision of the Executive to accelerate its promulgation.

“The plan changes based on what the government has announced a few moments ago, which has defined enacting a package of legislative measures, among which is Naín-Retamal, other important ones such as arms control,” he said.

That “immediately rules out the alternative of the Constitutional Court and makes us rather change course towards work on other measures that effectively contribute to protecting the Chilean Police and the population,” he added.

From the opposition, National Renovation (RN) deputies delivered a letter to President Boric for the murder of the police force. For his part, Senator Francisco Chahuán requested the resignation of the Undersecretary for Crime Prevention, Eduardo Vergara.
