London Trial: Partially Ruling in Favor of the Cuban Regime

MADRID, Spain.- The Superior Court of Justice of London ruled this Tuesday in favor of the Cuban regime on the trial against the Government of the Island and the Banco Nacional de Cuba (BNC) for non-payment of a debt of 72 million euros filed by investment firm CRF-I Ltd., based in Grand Cayman.

According to a note signed by regime spokesman Humberto López and shared by the official media, Judge Sara Cockerill notified the lawyers for the parties on Tuesday “the sentence corresponding to the lawsuit filed.”

“The sentence accepts the approach sustained by the Cuban party during the process and dismisses the CRF claim against the Cuban State. The judicial resolution confirms that the irregularities committed by BNC officials, first subject to a criminal investigation and later a judicial sentence, were reasonable grounds for the Cuban government to deny its consent to assign the debt in favor of CRF”, the note indicates.

“According to the sentence notified this morning,” he adds, “CRF is not a creditor of the Cuban State, which means that the Republic of Cuba is out of the lawsuit.”

However, despite the euphoria of the regime, which has replicated the information in most of its media, the process will continue against the Banco Nacional de Cuba, which will have the right to establish the claims allowed by English law.

The lawsuit against the Cuban Government and the BNC was filed on February 18, 2020. Last February the trial had been concluded for sentencing.

During the days After the trial, the Cuban authorities declared that CFR I is not a legitimate creditor, since it was obtained with this debt by bribing a BNC employee; as well as argument that the group is a vulture fund.

These arguments were denied by CFR I, which maintains that the group “is too small” to be considered “a vulture fund.” Just as he assures that he did not bribe any employee and has accused the Cuban regime of “fabricating pretexts.”

The trial sessions were accompanied by Cuban émigrés who they manifested outside the Court of Justice, denouncing and demanding payment of the debt from the regime.
