This Monday, the court prosecutor, Juan Gómez, received a delegation from the Uruguayan Press Association (APU) for the raid requested by the prosecutor Mariana Alfaro to the Azul FM radio station and the home of the journalist Ignacio Álvarez in the framework of the criminal investigation for the broadcast on the program “La Pecera” of audios of intimates linked to the case of “group rape” denounced by a 30-year-old woman.

After the meeting, and in the framework of a press conference, Gómez confided that prosecutor Alfaro’s mind was set on the “investigation of conduct with criminal appearance, did not consider what could be the affectation of a right that all journalists have, which is the reserve of sources”.

He added that said subsequent consideration of that right is what leads him to affirm that this measure was not complied with, will not be complied with and “there is no reason why any journalist should be subject to the seizure of his work instrument, as it’s your cell phone.

The court prosecutor stated that the information sought could be, but he is not aware, “in the possession of other journalists and that, however, it did not occur to anyone to claim those possible audios from them.”

He clarified that the origin of the whole situation is that the person under investigation stated that he had other audios or videos that would be important for the investigation of the fact.

He said that the decision of the acting prosecutor was based on article 92 of the Gender Law, which establishes: “Whoever disseminates, reveals, exhibits or transfers to third parties images or recordings of a person with intimate or sexual content, without their authorization. , will be punished with a sentence of six months in prison to two years in prison. In no case will the authorization granted by a person under 18 years of age be considered valid. This crime is configured even when the one who disseminates the images or recordings has participated in them. The administrators of Internet sites, portals, search engines or the like who, notified of the lack of authorization, do not immediately remove the images, will be sanctioned with the same penalty provided for in this article.

“That was what was being tried to achieve in a criminal investigation. In no way was trying to violate sources and rights consecrated internationally and also legally in our country, “said Gómez.

He claimed that the defense of the rights of the communicators is guaranteed, it does not run any type of risk. “We are not going to persecute any journalist.”

On the other hand, he clarified that the Attorney General’s Office is also “very interested in protecting all the rights that affect people and more than anything in relation to the victims.”
