CNI doctor and brother of politician Harry Jurgensen (RN) is a fugitive from justice: he was convicted of murder during the dictatorship

The collaborating doctor of the National Research Center (CNI) Manfred Jurgensen Caesar -brother of the ex-deputy and ex-conventional Harry Jurgensen Caesar (RN) – is a fugitive from justice for a homicide committed during the dictatorship.

The Supreme Court raised, in January 2023, the sentence against Jurgensen as co-perpetrator of the qualified homicide of the professor and militant of the MIR, Federico Alvarez Santibanezmurdered under torture on August 21, 1979. Thus, the highest court sentenced him to eight years in prison.

The court issued on January 20 the completion of the sentence, which could not be carried out because the doctor is a fugitive from justice.

Lawyer Francisco Bustosfrom Estudio Caucoto Abogados, pointed out that “people have to assume the consequences of their actions, especially considering the seriousness and nature of these crimes. For this reason, we hope that the authorities manage to find their whereabouts and that of all the fugitives for reasons of human rights”.

For Bustos, “it is striking that Mr. Jurgensen’s defense, in parallel, is seeking to replace the custodial sentence with house arrest, alluding to the age and state of health of the sentenced person. The facts, however, contradict them: for someone to be able to remain a fugitive from justice for two months seems to be a sign of good health, ”he said.

Let us remember that in the case, the Supreme Court confirmed the sentences against the CNI agents Julio Salazar Lantery, Carlos Duran Law, Jorge Andrade Gomez and Jorge Vargas Bories, to 10 years and one day in prison, as co-authors of the qualified kidnapping; and the doctor’s Luis Losada Fuenzalidato two years in prison, with the benefit of the conditional remission of the sentence, as a concealer.

The case

Federico Álvarez was arrested on August 14, 1976 when he was distributing pamphlets against the dictatorship. Subsequently, he was handed over to the CNI, whose agents tortured him for five days, until he was taken to a military prosecutor’s office, where he was admitted in a dying state.

During that time, three CNI doctors -among whom was Jurgensen- examined Álvarez. In the reports, they confirmed the good health of the victim.

He was then transferred to a hospital compound, where he died the following day.

At that time, the CNI affirmed that Álvarez was hit on the head by the police officers who detained him, but the doctors who attended him certified that he had multiple bruises, cigarette burns, electrical burns, rib fractures, and pulmonary contusion.

According to data from the Human Rights Secretariat, along with Jurgensen there are five other ex-agents who are fugitives from justice after being convicted of their participation in crimes against humanity.

They are the Army officer (r) and CNI Jorge Octavio Vargas Bories, also for the murder of Professor Federico Álvarez; Carabineros officer (r) Hector Fernando Osses Yanezwith four convictions for murders in the San Gregorio neighborhood; Victor Alvarez Droguett (DINA) for the qualified kidnapping of Martha Ugarte.

The other two are Ruben Arnoldo Morales Lopez (Carabineros officer (r)) for the qualified homicide of Jorge Vasquez Matamalaand Luis Enrique Barrueto Bartning (businessman), for seven qualified kidnappings perpetrated in the commune of Santa Bárbara.
