The Buenos Aires Federal Chamber rejected this Wednesday the request of the defense of Nicolás Carrizo to be sent to house arrest while the investigation of the attempted murder of Vice President Cristina Fernández de Kirchner lasts. The judges of the first chamber of the court of appeals resolved to “confirm the resolution dated February 10, 2023 in that it did not allow for the house arrest of Gabriel Nicolás Carrizo”, prosecuted with preventive detention as a secondary participant in the attack, and They highlighted that “the possibility of hindering the investigation” is still configured in the case, according to the ruling to which Télam agreed.
In the same resolution, and through two differentiated votes, the magistrates urged federal judge Capuchetti to move towards the oral and public trial for the event that occurred on September 1, 2022 for which, in addition to Carrizo, those accused of being the perpetrators of the attempted murder are being held: Fernando Sabag Montiel and Brenda Uliarte.
Judges Leopoldo Bruglia and Pablo Bertuzzi ordered through a joint vote “to urge the a quo -taking into account what was rightly stated by the defense- that in view of the situation of detention of the accused and the state of the investigation in this regard, proceed with the speed that the case requires in order to advance in the procedural stage”, which would imply taking the case to an oral and public trial.

For his part, Judge Mariano Llorens held that “beyond the fact that the term of the process does not seem excessive for the different investigation hypotheses suggested by the complaint -those that have not yet been proven even with the degree of certainty that this stage requires – The truth is that it seems inadmissible that the main fact has not been raised to trial when the investigation in its regard is exhausted and with its defendants in preventive detention.
The complaint recently made various proposals to investigate whether there are masterminds who operated behind Sabag Montiel and Uliarte, at the same time that it requested that it be investigated whether by action or omission they had any participation in the assassination attempt.
