Congress LIVE: final report recommends accusing Betssy Chávez as a co-author for rebellion and conspiracy

The Subcommittee on Constitutional Accusations (SAC) of Congress will debate this Monday, March 6 the final report of the complaint against Betsy Chavez and the ex-ministers Willy Orchard (inside) and Roberto Sanchez (Foreign Trade and Tourism) due to the coup perpetrated on December 7, 2022 by the then president Pedro Castillo in the modality of rebellion and conspiracy to the detriment of the state.

After the extensive reading of the final report by Wilson Soto, the debate began in the Subcommittee on Constitutional Accusations (SAC). Parliamentarian José María Balcázar of Perú Bicentenario questioned the report, warning that the document suffers from a serious analysis and with flaws: “We cannot be a table for parts of the Prosecutor’s Office.”

The final report prepared by Congressman Wilson Soto recommended accusing Betssy Chávez as a co-author for rebellion and conspiracy, giving the National Prosecutor’s Office the green light to proceed with its investigations and subsequent prosecution after a possible lifting of the preliminary hearing.

The document presented by parliamentarian Wilson Soto also suggests that charges be made for these alleged crimes against former ministers Willy Huerta (Interior) and Roberto Sánchez (Foreign Trade and Tourism).

After completing the reading of the final report by Wilson Soto, the Subcommittee on Constitutional Accusations (SAC) will debate and then vote. This will have to be ratified in plenary, after them – lifting the preliminary trial – the Public Ministry may accuse the former ministers of Pedro Castillo in case it finds them responsible for the alleged crimes of rebellion or conspiracy.

According to article 346 of the Criminal Code, the person responsible for the crime of rebellion must receive a sentence of not less than 10 years and not more than 20. Meanwhile, article 349, which details the penalties for the crime of conspiracy ” It will be punished with a custodial sentence of no more than half of the maximum indicated for the crime that was perpetrated.

Wilson Soto delimits the actions of the SAC in a pretrial process

“In a pre-trial process, the commission of alleged crimes charged is not analyzed extensively or in depth, but must be limited to determining whether the facts or conducts charged to the accused can be adapted to the criminal types charged (by the National Prosecutor’s Office )”, commented Wilson Soto during the reading of the final report.

It was Congressman Wilson Soto Palacios (Popular Action) who presented his final report to the SAC as delegate of the case for the constitutional complaint filed by the National Prosecutor, Patricia Benavides, for the coup d’état by Pedro Castillo.

“Complying with the established processes and deadlines, with responsibility and objectivity, we have submitted to the Subcommittee on Constitutional Accusations the Final Report of Constitutional Complaint 328 against the former ministers of Pedro Castillo”, wrote the parliamentarian on his Twitter account.

Although the statement of Willy Orchard before the Prosecutor’s Office is key when pointing out that Bettsy Chavez and Hannibal Torres were inside the presidential office when Castillo Terrones announced the closure of Congress, the former head of the ministerial cabinet denied having been aware that the former president would attempt a coup.

The then head of the Council of Ministers also confirmed the presence of Aníbal Torres during the reading of the message to the nation and other ministers. “He just read his message, we were cold. He finished his message, I approached him, and the president tells me: ‘It’s a complex decision. Strength’. And, well, Dr. Aníbal spoke with him at that moment and, a few minutes later, I saw the resignation of some colleagues by the media,” Chávez said.
