INE prepares constitutional controversy against "Plan B" electoral

The president of the National Electoral Institute (INE), Lorenzo Córdova, reported that this body will shortly present a constitutional controversy in the Supreme Court of Justice of the Nation (SCJN) against the so-called electoral “Plan B” of the federal government and Morena, since it “drastically modifies the structure of the INE, thus putting thousands of positions in the professional service at risk and therefore the reliability of the electoral processes.”

“Plan B”, he said, “the test to which it will be submitted to the courts of the Republic will not subsist; he trusted that the Judiciary will restore the constitutional and democratic order in our country”.

In a Sunday video message, Córdova Vianello affirmed that it is time for the ministers of the Court, in whom he said he trusted that they will act responsibly and independently as the true guardians of the Constitution.

“The defense of democracy will continue to be the priority in the weeks to come, regardless of the disqualifications and acts of intimidation that unfortunately are undertaken from the highest spheres of power,” he said.

He said that the reform decree of the so-called “Plan B” of President Andrés Manuel López Obrador had immediate effects, such as the dismissal of the executive secretary of the INE, Edmundo Jacobo Molina, a fact that he considered illegal.

“This cessation was ordered by the reform from the publication of the decree, that is, even before its entry into force, which shows, among many other things, the violation of the autonomy of the INE and also the legislative untidiness of that reform,” he said.

He stated that the INE has always respected the rule of law, legality, the division of powers and regulations, even if they are regressive and unconstitutional.

For this reason, we have already begun to abide by what this arbitrary and undemocratic law obliges us to do as long as the corresponding judicial authorities do not declare it unconstitutional,” he said.

He recalled that last Friday the INE General Council met, which approved an agreement to appoint Roberto Heycher Cardiel Soto as head of the office of the Executive Secretariat; and another agreement to create a technical commission of advisers in charge of the implementation of said reform within the national electoral body, while the SCJN and the Electoral Tribunal of the Federal Judiciary (TEPJF) resolve the appeals and lawsuits promoted.

He mentioned that the possibility is also open for INE workers who see their work threatened, or any citizen in general who feels their rights affected, to file lawsuits against the so-called “Plan B” and its implementation in the INE.

“From the moment these reforms were published, the INE began the legal battle in defense of the institution of the general electoral system, the labor rights of our workers and democracy in general.

“In addition, in the next few days we will promote a constitutional controversy so that it is the Supreme Court of Justice of the Nation that decides if they are constitutional or not, both the content of the reform and the way in which this untidy legislative process was developed,” he stressed. .

Finally, he said he was confident that the Federal Judiciary would not let go of the “constellation of irregulars” in the content of the reform, such as the approval process.
