Say Goodbye to Spam Calls: Congress Passes Ruling Banning Disruptive Communications

The Plenary of Congress unanimously approved the ruling that prohibits calls and communications in order to benefit users. The initiative modifies Law 29571, Consumer Protection and Defense Code.

The legislative proposal states that it is prohibited to “use call centers, telephone call systems, sending text messages to cell phones or mass electronic messages to promote their products and services, as well as providing telemarketing services, to no consumer.

The only exception is the sending of commercial or advertising communication to those people who contact the provider directly and authorize this.

To do this, this person must give their free, prior, informed, express and unequivocal consent to be contacted through the telephone number, email address or any other similar means of communication.

However, this permission can be revoked at any time and in accordance with the regulations governing the protection of personal data, without any kind of restrictions being placed on it.

If this prohibition is violated, it gives rise to a very serious offense sanctioned by the Consumer Protection and Defense Code, the document states.

It should be noted that in 2021, Peru ranked as the second country with the most annoying calls in the world, below Brazil, according to Truecaller Insights. A person received an average of 18 of these communications per month that year.
