Parties will not be able to set up trusts with remainders for campaigns, foresees TEPJF

Reyes Rodríguez’s project rejects the proposals of Movimiento Ciudadano in the sense that the INE lacks the proper foundation and motivation, because it did not analyze, interpret or set a general and mandatory criterion for all political parties.

For this reason, it proposes to confirm the agreement of the INE, since contrary to what was alleged by the orange party, it considers that the INE did analyze its approach and the conclusion it reached generally applies to any political party, but not so Exclusive for Citizen Movement.

In addition, it considers that the challenged determination is not inconsistent, since it is clear that the General Council indicated that the trust in the terms proposed by MC was outside the electoral regulations, because there was no specific rule that allowed its exercise.

“The contested response is confirmed, because the alleged legal, formal and substantive violations are non-existent. Additionally, the conclusion is shared with the responsible authority that ordinary spending resources should not be saved to be used in campaigns in accordance with the constitutional and legal model of financing, in addition, the trusts that the regulation on auditing matters authorizes for the political parties do not have the purpose intended by the party”, refers to the 33-page project.
