Indecopi fines Gloria more than S/600,000

Indecopi’s Consumer Protection Commission No. 2 fined, in the first instance, more than S/600,000 to for consigning on the label of its product “Soy Vida” of 150 grams and 400 grams the denomination “evaporated soy milk” and on the 1L label “UHT soy milk”, which, according to the regulator, misleads consumers, making them think that it would indeed be evaporated milk despite the fact that, due to its composition, this would not be true.

The complaint against the company was filed by the Peruvian Association of Consumers and Users (Aspec) and, in the first instance, the Commission determined that the company had infringed the Consumer Protection and Defense Code, for which reason it imposed a total fine of 124.95 UIT, that is, S/618,502.5.

It should be noted that article 32 of the Code states that food must prominently bear on its label the name that reflects its true nature, without generating confusion or deception to the consumer.

Indecopi specified that now Glory is within the term to appeal said pronouncement before the Specialized Chamber for Consumer Protection of Indecopi, the second and last administrative instance of the institution.

In this regard, the executive president of Indecopi, Julián Palacín Gutiérrez, pointed out that this first instance decision contributes to the defense of food and consumer health and the right to information.

“It is essential that all companies are transparent in the labeling of their products, even more so if they are for mass consumption, such as dairy products, which, in addition, are the nutritional basis of children’s food,” he stressed.
