“The authority has four months to impose the respective fine, counted from the end of the ten-day period granted to allege and prove in defense of the person who is alleged to have a conduct punishable by a fine,” determined the first room of the Supreme Court according to a statement issued by the Consar.
In this way, he assures, the principles of legality and legal certainty are respected.
The Consar does not mention the affected Afore.
The determination arose after the Consar detected inconsistencies in the past in a Siefore (Specialized Investment Company for Retirement Funds) that is managed by an Afore with the objective of investing the resources from individual accounts.
The authority required the Afore to “adopt corrective measures” and to submit a work plan with evidence of the correction within 10 days.
The firm filed an amparo claiming the term that the Consar had set unconstitutional.
